The alternative disputes of insurance case by syari'ah disputes can be settled by 3 approaches: 1)by negotiation, 2)by badan arbitrase syari'ah nasional [BASYARNAS] and 3)by Islamic Court. The principles conduct to syariah i.e: 1)al hurriyah [freedom],2)at taradhi, 3)al musawah [equality], 4)al dalah [fairness],5)al amanah, 6)al intifa [utility] and 6)halalan thayyiban. The parties may choose the alternative disputes institution. Based on doctrine of law that's law has no retroactive and based on freedom of contract, the parties may use Basyarnas firstly. If Parties have goodwill to go to Islamic Court it would better because the existent of law court stronger than arbitartion or others.yo.
