The codification of Moslem law need many mouslem theoretician who have good quality to do ijtihad. They must have collective ijtihad tradition. Human reseurces in legislative institusion firstly focused of ijtihad to find the law. Rechtsvinding or specially ijtihad is done as maximize effort on legislative, judicative and executive institutions. By Moslem law codification, it is not limiting the discretion power of judge to do ijtihad. Then, the revised law or improvement continuously supports the judge duties in order to hold spirit moslem law to be synchronization. Moslem law as one codification is hoped to progress forever in social community as like new invention by doing ijtihad; namely individual ijtihad and collective ijtihad. The essential problem that must be solved is how to to build and apply ijtihad in representative institusion. The representative institusion has potential value to create new concept, idea or improvement to revise the law, in context Moslem law.yo.
