Islamic law exists as response on social phenomena, there be as the consideration from god. al Qur'an and hadits as source and foundation of Islamic law, but mujtahid has an understanding in giving the meaning on al Qur'an and hadits related with the context. This writing will describe an Na'im thingking about the doctrine on Islamic criminal law. an Na'im tries to give the meaningon nasakh and mansukh based on the previous ulama. His thingking is inspired by his teacher Mahmoed Muhammad Thaha and he wants to clarify that Islamic criminallaw is suitable with the human right.yo.
